In accordance with the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights (the "Directive"), we wish to inform our customers that, due to the nature of digital products, there is no right of withdrawal and no withdrawal period once the digital product (such as video courses, templates, or other downloadable content) has been successfully delivered.
Legal Basis for No Right of Withdrawal
As per Article 16(m) of the Directive 2011/83/EU, consumers do not have a right to withdraw from contracts for the supply of digital content that is not delivered on a tangible medium once the performance has begun, which typically happens once the content is made available for download or accessed. This is because digital content can be easily copied, shared, and consumed immediately, making it difficult for the seller to enforce the terms of return.
Reasons for No Refunds or Returns
Easy Copying and Distribution
One reason digital products cannot be returned or refunded is that they can be easily copied or distributed. Once a digital product is downloaded or accessed, it can be copied and shared with others, making it impossible to track and control its distribution. After purchase, the seller cannot ensure that the digital product is being used only by the original purchaser. As a result, digital products are exempt from the standard return policies for physical products.
Immediate Access and Consumption
Another reason for no returns or refunds on digital products is that they can be accessed and consumed immediately. Unlike physical products, which require time for shipping and delivery, digital products are typically available for download as soon as the purchase is completed. This means that once a digital product is purchased, the seller has no way to ensure that the product hasn't already been accessed or consumed by the buyer, making the return process unfeasible.
Malfunctions or defects in the templates are not valid reasons for a return or refund. We make sure that all templates are working properly before they are available for download. However, if issues arise due to user error or misuse, they will not be eligible for a refund.
Exceptions and Refunds in Case of Errors
In the case of an error during the purchase process (for example, if the wrong product was accidentally purchased), we are happy to review the situation. If the error is verified, we will proceed with a full refund. Please be aware that any refund requests will be assessed on a case-by-case basis, and we reserve the right to refuse refund requests that do not meet the legal criteria.
Consumer Rights Under the Directive
It is important to note that the Directive 2011/83/EU provides specific rights for consumers in the European Union. However, those rights are subject to certain conditions. For digital products, once access has been provided to the consumer, the right to a refund or withdrawal is effectively voided (Article 16). If the consumer has not yet accessed the digital product, they may still be entitled to a refund if the purchase is cancelled within the legally defined period.
We strongly recommend that customers thoroughly review the product details before completing the purchase, as no refunds or returns will be accepted once the digital product has been downloaded or accessed.
